The defendant, Paul J. Rowe, appeals from a jury verdict finding him guilty of murder in the second degree, in violation of Neb. Rev. Stat. 28-304 (Reissue 1979), on July 21, 1982. Murder in the second degree is a Class 1B felony punishable by imprisonment for a period of not less than 10 years, or life. On July 29, 1982, the court sentenced Rowe to imprisonment for a term of 25 years. This is the second time this case has been before this court. Our first opinion is reported in State v. Rowe, 210 Neb. 419, 315 N.W.2d 250 (1982) (Rowe I). In Rowe I, we reversed the homicide conviction because of the trial courts failure to instruct the jury on the lesserincluded offense of manslaughter and remanded for a new trial. We did, however, affirm the arson conviction and sentence which was imposed by the trial court, and that arson conviction is not involved in this appeal.
